[...] This text harmonizes the conditions ofaccessaccess to the profession of lawyer in all member states, by setting criteriaiscommon requirements: initial training, obtaining the Certificate of Aptitude to the Profession of Lawyer (CAPA), completion of a professional internship, but also respect for a certain number of rulesisethical and deontological rulesincompatibilityiss. L'The objective is to ensure equal treatment between professionals and facilitate their free movement within the community space. However, this ambition sometimes encounters legal obstacles. In fact, certain internal norms sometimes contest the direct application or uniform interpretation of this risregulation. It is precisely in these situations of tension that the role of the Court of Justice takes on its full meaning. As the guardian of community law, it is responsible for ensuring its interpretation and respect. [...]
[...] The first part of our reasoning focused on highlighting the normative framework governing access to the profession of lawyer within the UEMOA space, revealing the density of the community's legal foundation. Supported by a range of texts with binding value, from the Treaty of the Union to regulations and additional acts, this corpus establishes a common grammar, based on the free movement of skills, the principle of non-discrimination, and the mutual recognition of professional qualifications. By laying the first milestones of a common requirement, the derived law of the Union aims not only to harmonize the conditions of access but also to redefine, through them, the contours of a regional professional citizenship. [...] Rather than imposing a rigid uniformization, the Court chooses a middle path: making community principles prevail without erasing the margins of adaptation of member states. The pursued goal is clear: to ensure the unity of the West African legal market without directly challenging the sovereignty of member states. The results achieved are significant. The analysis demonstrates that the Court of Justice of the UEMOA, by acting as a guardian of the respect of community law, has been able to evolve the professional status of lawyers towards a form of regional universality, without denying the legitimate margins of interpretation of national legislators.
